1. Acceptance of Terms

By accessing and using GradeVideo ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

GradeVideo is a video-first educational platform designed for K-12 schools and districts. The Service enables teachers to create video assignments, collect student submissions, provide time-based feedback, and manage educational workflows.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account with accurate, complete, and current information. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

3.2 Eligibility

The Service is intended for educational institutions, teachers, students, and administrators. Users must be at least 13 years old or have parental consent. For users under 18, school district consent is required.

3.3 Account Responsibilities

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

4. Acceptable Use

4.1 Permitted Use

You may use the Service for legitimate educational purposes, including but not limited to: creating assignments, submitting video content, providing feedback, and collaborating within educational contexts.

4.2 Prohibited Activities

You agree not to: (a) use the Service for any illegal or unauthorized purpose; (b) upload, transmit, or distribute content that is harmful, threatening, abusive, defamatory, or otherwise objectionable; (c) attempt to gain unauthorized access to the Service or related systems; (d) interfere with or disrupt the Service or servers connected to the Service.

5. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices. By using the Service, you consent to the collection and use of information in accordance with our Privacy Policy.

6. Intellectual Property

6.1 Service Content

The Service and its original content, features, and functionality are and will remain the exclusive property of GradeVideo and its licensors. The Service is protected by copyright, trademark, and other laws.

6.2 User Content

Users retain ownership of content they submit to the Service. By submitting content, you grant GradeVideo a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

7. Educational Data and FERPA

GradeVideo is designed to be FERPA-compliant and handles educational records in accordance with applicable laws. We implement appropriate administrative, technical, and physical safeguards to protect student education records.

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or improvements that may temporarily interrupt service. We are not liable for any downtime or service interruptions.

9. Termination

We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.

10. Limitation of Liability

In no event shall GradeVideo, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

11. Governing Law

These Terms shall be interpreted and governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from these terms will be resolved in the courts of McKinney, Texas.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
